Firing a Lawyer

Many times clients forget that they are the bosses. A client can fire a lawyer at anytime, regardless of the terms of a fee agreement and even if the case is pending in court. The attorney is entitled to payment for services rendered up to the time of dismissal, in accordance with the agreement.

Dismissing a lawyer after an action is filed usually requires the court's permission. Changing lawyers after the legal process has started can be very expensive.

The court may be reluctant to grant permission for dismissal if the case is close to trial and it will delay the proceedings unless the court good cause under the circumstances for the dismissal.
